What if you allow continuous auction in which different parties
can bid on the current valuation of the patent, or its fraction,
or bet on the derivatives? The inventor can originally own 100%
of the patent stock, and take part in the market. The government
would at any point keep the reimbursement of the patent holders
at the levels proportional to their share of its valuation, while
keeping it in public domain; sometimes it can tell that the patent
should be sold, in which case it takes the money from the patent
share holders and sends them to the market.
I am afraid that the patents would be overvalued by a factor reverse
to the probability that the patent may be sold...
